Termite
Control Company Liability
A significant
percentage of CLF’s
practice is devoted to
bringing cases against
termite control companies,
including national companies
such as Orkin and Terminix.
CLF’s founder,
26 year trial lawyer Pete
Cardillo, has handled these
types of cases since 1996.
Over the
course of developing this
significant experience,
Cardillo has successfully
settled many cases favorably
for his clients. By focusing
on this very unusual area
and honing his specialty
over the last twelve years,
CLF has a tremendous reservoir
of experience and resources.
There is no “learning
curve”, and because
termite companies typically
very aggressively deny
claims and very aggressively
defend cases, CLF is well-equipped
to deal with the full array
of weapons at the disposal
of the termite companies,
which are considerable.
Termite
Damage Insurance Claims
In addition to claims
against termite companies,
many property owners may
also have insurance coverage
under their property insurance
policies. Unfortunately,
most property owners are
unaware of this coverage.
To compound matters, most
insurance agents will tell
property owners that they
do not have coverage under
the policies even when
they do.
Along with pursuing termite
companies, CLF has a tremendous
track record of success in
collecting awards under property
owner insurance policies.
Because coverage for termite
damage is highly technical,
most lawyers do not
realize that there can often
be coverage, even if there
are termite exclusions in
the policies.
Similar to the termite
companies, most insurance
companies vigorously deny
and defend such claims. CLF
is uniquely qualified and
experienced to take on the
aggressive and often unfair
practices of insurance carriers.
Claims
Against Sellers of Termite
Damaged Property
All
too often, especially in
the southeast United States,
termite infested or damaged
properties are sold to
unsuspecting buyers. Sometimes,
the seller had no idea about
the termite damage. Too often,
however, the seller knows
full well that there is damage,
but chooses to conceal the
damage and cheat the buyer.
CLF has substantial experience
in representing property
owners who are victimized
by sellers who fail to disclose
termite damage. Even if there
is language in the sales
contract which would seem
to completely protect the
seller or real estate agent,
property owners often still
have recourse under the law.
