Termite Pest Control Company Liability

When Your Exterminator Fails to Control Termites and They Cause Damage

A significant percentage of Cardillo Law’s practice is devoted to bringing cases against termite control companies, including national companies such as Orkin, Truly Nolen and Terminix. Termite pest control companies face significant liability for termite infestation and resulting termite damage. This liability, however, is almost always limited to some extent by the terms and conditions of the contract between the property owner and the termite company. Frequently, these contractual limitations and disclaimers have been found to be illegal under Florida and other states’ laws. Our goal is to hold termite companies accountable and responsible for their failures, despite such one-sided agreements.

Additionally, employees of termite pest control companies unfortunately have been found to intentionally cut corners when either treating or inspecting the properties of their customers. All too frequently, this intentional misconduct can rise to the level of fraud. Through relentless and aggressive action, Cardillo Law Firm has unearthed internal documentation confirming fraudulent practices in some cases. The firm is well versed in all of the termite company “tricks”, including falsified reinspection documents, fake treatments, and other deceptive practices. The firm can therefore quickly zero in on such misconduct through diligent and persistent investigation. If improprieties are found, these cases may support claims for punitive damages against the termite companies.

Cardillo Law’s founder, 30 year trial lawyer Pete Cardillo, has handled termite claim cases since 1996, developing significant experience in termite law and litigation. By focusing on this very unusual area of the law and honing its specialty, Cardillo Law has developed a tremendous reservoir of experience and resources. There is no “learning curve”, and because termite companies typically very aggressively deny claims and defend cases, Cardillo Law is well-equipped to deal with the full array of legal maneuvers at the disposal of the termite companies.
